CLE Dog Adoption Program

Terms & Conditions

1. NO PURCHASE NECESSARY TO ENTER OR WIN.
2. HOW TO ENTER: Beginning on February 12, 2024, at 6:00am Eastern through the earlier of: (i) December 31, 2024, at 11:59pm Eastern; or (ii) the date on which all prizes have been distributed, log on to www.YourDayinCLE.com and click on the icon for the CLE Dog Adoption Program and follow the on-screen entry instructions. Fill in all required information. You may enter only once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.
3. ELIGIBILITY: Open to U.S. Citizens (other than individuals already residing in the following Ohio counties: Cuyahoga, Lake, Lorain, Geauga, Medina, Ashtabula, Summit, or Portage) as well as citizens of any other country 18 years of age and older as of February 12, 2024, except for employees of Destination Cleveland, their affiliates, subsidiaries, and agencies (collectively “Promotion Parties”), and members of their immediate family or persons living in the same household. Void where prohibited. Qualifying entrants must have moved to Cuyahoga County, Ohio, on or after February 12, 2024, and must provide documented proof of residency in the form of two consecutive months of one utility bill that shows the entrant’s name at a service address within Cuyahoga County. Qualifying entrants must also provide proof of previous residence in the form of utility bills from the two months preceding entry, which bear the entrant’s name at a service address outside of Cuyahoga County.
4. SELECTION: Selections of incentive recipients will be conducted on an as-received, first-come first-served basis from eligible submissions starting on or about February 12, 2024, and ending December 31, 2024, by Destination Cleveland. The Promotion is available only to the first one hundred (100) eligible submissions. Potential winners will be notified by email or phone and must sign and return any required Affidavit of Eligibility and Release within fourteen (14) days of the date notice is sent or such other date set by Destination Cleveland. Failure to respond within the applicable time period will result in forfeiture of any incentive, and Destination Cleveland shall have the option to award the incentive to the next eligible entrant. The return of any incentive notification or incentive as undeliverable may result in disqualification and the next eligible entrant will be selected. Any income or other taxes resulting from acceptance of an incentive are the sole responsibility of entrant. By entering this program, entrant accepts and agrees to these Official Rules and the decisions of Destination Cleveland, which shall be final in all matters. Acceptance of an incentive also constitutes permission to the Promotion Parties to use entrant’s name, likeness, and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.
5. LIMITATION OF LIABILITY: By entering this program, entrants waive all right to, and hold the Promotion Parties harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this program or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: any income or other taxes resulting from acceptance of an incentive; late, incomplete, or incorrect entries; an entrant’s failure to receive incentive notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this ; by any human error which may occur in the processing of the entries in this program; or any typographical, technological, or other error in the publishing of the offer, administration of the program or announcement of the incentive awards. If, in Destination Cleveland’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the program, or if technical difficulties (including viruses and bugs) compromise the integrity of the program, Destination Cleveland may, in its sole discretion, cancel or modify this program in a manner deemed appropriate. In the event of termination, incentives will be awarded to all remaining eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially selected entrant, entries will be declared made utilizing the name provided on the online entry form.
6. INCENTIVES: Total prize value: $300. Prize consists of either of the following, at the prize winner’s discretion: (i) $300 toward the adoption of a dog from a Cuyahoga, Lake, Medina, Ashtabula, Portage, Geauga Summit or Lorain County rescue shelter or animal protective organization approved by Destination Cleveland in its sole discretion (the “Adoption Incentive”), subject to the prize winner’s adoption eligibility as determined by the rescue shelter or animal protective organization’s sole discretion; or (ii) a one-year membership (valued at $300) to Taps & Tails, an indoor/outdoor dog park and bar located in Cleveland, Ohio (the “Membership Incentive”). Destination Cleveland specifically disclaims any warranty of any kind related to the services of any other organization listed in these Official Rules.  Limit one Adoption Incentive or Membership Incentive per family or household. No substitution (other than the selections provided for in this Section) or transfer of incentive permitted by winner. Destination Cleveland reserves the right to substitute an incentive of equal or greater value. All Adoption Incentives will be awarded directly to the selected rescue shelter or animal protective league on each prize winner’s behalf. If an entrant is disqualified for any reason, Destination Cleveland will award the applicable incentive to an alternate entrant by selecting the next remaining eligible entry.
7. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of Ohio, without giving effect to any provisions governing the conflict of laws. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this program and these Official Rules shall be brought exclusively in the applicable federal or state courts located in Cleveland, Ohio.
